About LrnQik

LrnQik is an education and tuition marketplace designed to facilitate connections between individuals seeking tuition services and tutors.

LrnQik may provide features that allow eligible users to post tuition requirements, discover tuition opportunities, communicate with each other, use educational resources and access other related services.

Definitions

For these Terms:

• "LrnQik", "we", "us" or "our" means the LrnQik platform and its operator.
• "User", "you" or "your" means any eligible person accessing or using LrnQik.
• "Tutor" means an eligible adult who registers or participates on LrnQik for the purpose of providing tuition or educational services.
• "Parent/Guardian" means an eligible adult parent or legal guardian seeking tuition for a learner.
• "Adult Student" means an eligible student aged 18 or above who uses LrnQik independently.
• "Tuition Requirement" means information submitted by a Parent/Guardian or eligible Adult Student describing a tuition need.
• "Coins" means LrnQik's platform credits, where applicable, that may be used for specified LrnQik features.

Eligibility

LrnQik is an 18+ platform. You must be at least 18 years old to independently access or use LrnQik services.

A person below 18 years of age may not independently create an account, post a tuition requirement, register as a tutor, unlock contacts, contact other users, purchase coins or otherwise use LrnQik.

Where tuition is required for a learner below 18, an eligible Parent or legal Guardian aged 18 or above may use LrnQik on behalf of that learner, where permitted.

Creating and Maintaining an Account

Where account registration is required, you agree to provide accurate, current and complete information.

You are responsible for maintaining the accuracy of your information and for keeping your account credentials secure.

• You must not create an account using another person's identity without authorization.
• You must not knowingly provide false or misleading information.
• You must not allow another person to improperly use your account.
• You should notify LrnQik if you reasonably believe your account has been compromised.

Guest Tuition Posting

Where available, LrnQik may permit an eligible adult Parent or legal Guardian to submit a tuition requirement without creating a full account.

By submitting a guest tuition requirement, you confirm that the information provided is accurate to the best of your knowledge and that you are authorized to provide the submitted information.

Guest-posting information may be used to process the requirement and facilitate communication with relevant tutors.

Posting a Tuition Requirement

A Parent/Guardian or eligible Adult Student may provide information relating to the tuition they are seeking, including subject, class, board, preferred location, mode of tuition and other relevant requirements.

You agree not to submit fraudulent, misleading, inappropriate or unlawful tuition requirements.

LrnQik may review, modify, reject, remove or restrict a tuition requirement where reasonably necessary to maintain the safety, integrity or proper operation of the platform.

Tutor Registration and Profiles

Tutors must be at least 18 years old and should provide truthful information about their qualifications, experience, subjects, location and teaching preferences.

Tutors are responsible for ensuring that their profile information does not contain false, misleading or fraudulent claims.

LrnQik may verify or request supporting information where reasonably necessary, but any verification does not constitute a guarantee, endorsement or certification of a tutor's services.

Contact Sharing

Direct Communication Between Users

Once contact information has been shared, communication between the tutor and the Parent/Guardian or Adult Student may take place directly by telephone, WhatsApp or other communication methods.

LrnQik is not responsible for the content, promises, representations, negotiations or arrangements made directly between users.

Users are responsible for independently discussing and confirming matters such as tuition fees, schedules, duration, location, teaching method, payment arrangements and other terms of their private tuition relationship.

User Responsibilities

All users must use LrnQik responsibly and in accordance with these Terms and applicable law.

Safety and Personal Meetings

Users should exercise reasonable caution when communicating with or meeting another person introduced through LrnQik.

• Verify relevant information before entering into a tuition arrangement.
• Consider meeting in an appropriate and safe environment where applicable.
• Do not share sensitive personal, financial or authentication information unnecessarily.
• Report suspected fraud, harassment, abuse or serious misconduct to LrnQik.

LrnQik does not control private meetings or communications between users and cannot guarantee the conduct of any individual user.

Fees, Payments and LrnQik Coins

LrnQik may offer paid features or services from time to time. Where applicable, fees and pricing will be displayed through the relevant LrnQik interface.

LrnQik may use a coin or credit system for certain tutor features, including the ability to unlock or access contact information associated with tuition requirements.

When a tutor uses the applicable feature to unlock a contact, the relevant number of LrnQik coins may be deducted from the tutor's account.

Users are responsible for reviewing the applicable price, coin requirement and feature description before completing a transaction.

Contact Unlock Refunds

Situations that normally do not qualify

• The Parent/Student does not answer a call.
• The Parent/Student does not reply on WhatsApp.
• The Parent/Student responds late.
• The Parent/Student chooses another tutor.
• The parties communicate but do not agree on fees, schedule or other terms.
• The tuition arrangement does not ultimately take place.

False, abusive, repeated or fraudulent refund claims may be rejected and may result in restriction or suspension of the relevant account.

No Guarantee of Tuition Leads or Earnings

LrnQik does not guarantee that a tutor will receive any particular number of tuition requirements, enquiries, calls, messages, students or earnings.

Similarly, LrnQik does not guarantee that a Parent/Guardian or Adult Student will find a suitable tutor through the platform.

Results may depend on location, subject, class, tutor availability, user preferences, competition, timing and other factors outside LrnQik's control.

User Content

Users may submit information, descriptions, profile content, tuition requirements, reviews, messages and other material through LrnQik.

You are responsible for the content you submit and must have the necessary rights and authority to provide it.

You must not submit content that is unlawful, fraudulent, defamatory, abusive, threatening, sexually explicit, discriminatory, misleading or otherwise inappropriate for the platform.

By submitting content, you grant LrnQik a non-exclusive right to use, store, reproduce, display or process that content as reasonably necessary to operate, maintain and improve the platform, subject to the Privacy Policy and applicable law.

Reviews and Ratings

Where LrnQik provides review or rating features, users must provide honest and genuine feedback based on their actual experience.

Users must not create fake reviews, manipulate ratings, offer incentives for misleading reviews, threaten another user over a review or post deliberately false information.

LrnQik may remove or restrict reviews that violate these Terms or applicable rules.

Prohibited Activities

You must not use LrnQik to:

• Provide false, fraudulent or misleading information.
• Impersonate another person or organization.
• Harass, threaten, abuse or intimidate another user.
• Send spam or unrelated promotional messages.
• Sell, publish or distribute another user's contact information.
• Add another user's phone number to unrelated marketing lists without appropriate permission or lawful basis.
• Scrape, collect or compile user contact information for commercial or unrelated purposes.
• Attempt to bypass, manipulate or exploit LrnQik's coin or contact-unlocking system.
• Submit fraudulent refund claims.
• Attempt unauthorized access to accounts, systems or databases.
• Use LrnQik for unlawful activities.

Intellectual Property

The LrnQik website, branding, logo, design, software, text, graphics, layout and other platform materials may be protected by applicable intellectual-property laws.

Except where permitted by law or expressly authorized by LrnQik, users must not copy, reproduce, modify, distribute, sell or commercially exploit LrnQik materials.

Privacy and Personal Information

Your use of LrnQik is also subject to our Privacy Policy, which explains how LrnQik collects, uses, shares and protects personal information.

Disclaimers

LrnQik provides its platform and services on an "as available" basis to the extent permitted by applicable law.

LrnQik does not guarantee that the website or services will always be available, uninterrupted, error-free or completely secure.

LrnQik does not guarantee the qualifications, identity, conduct, suitability, availability, reliability or performance of any particular tutor, Parent/Guardian or Adult Student.

Users should independently verify information and make their own decisions before entering into a tuition arrangement.

Limitation of Liability

To the maximum extent permitted by applicable law, LrnQik and its operator shall not be liable for indirect, incidental, special, consequential or other losses arising from or relating to the use of the platform.

This includes, where legally permitted, losses arising from user-to-user interactions, tuition arrangements, communications, missed opportunities, inaccurate user information, or conduct of another user.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless LrnQik and its operator from claims, losses, liabilities, damages and reasonable expenses arising from:

• Your violation of these Terms.
• Your unlawful or improper use of LrnQik.
• Your misuse of another user's personal or contact information.
• Content submitted by you.
• Your private arrangements or dealings with another user.

Account Suspension and Termination

LrnQik may suspend, restrict or terminate an account where reasonably necessary, including where a user:

• Violates these Terms.
• Provides false or fraudulent information.
• Misuses another user's contact information.
• Engages in harassment, spam or abuse.
• Attempts to manipulate the coin or refund system.
• Creates a safety or security risk.
• Uses LrnQik unlawfully.

Where appropriate, LrnQik may also remove associated content or restrict access to particular features.

Changes to These Terms

LrnQik may update these Terms from time to time to reflect changes in its services, technology, business practices or applicable legal requirements.

The updated version will be published on this page with a revised "Last Updated" date.

Your continued use of LrnQik after an updated version becomes effective may constitute acceptance of the revised Terms, to the extent permitted by applicable law.

Grievance and Complaints

If you have a complaint or concern regarding LrnQik, another user, misuse of contact information, account activity, transactions or another aspect of the service, you may contact LrnQik using the contact details below.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws applicable in India, subject to any mandatory legal rights or requirements that may apply.

Subject to applicable law, disputes relating to these Terms or the use of LrnQik shall be subject to the jurisdiction of the competent courts having jurisdiction over LrnQik's place of operation in West Bengal, India.
